Good afternoon! I’m really interested in this apartment, but before I sign the lease, I’d like to clarify a few terms.

First, I noticed the lease states that the lease tenure is 12 months. Would you be open to a shorter lease, maybe six months?
Landlord
We typically require a one-year commitment, but we could discuss a shorter lease for a higher monthly rent.
Tenant
I see. Also, the security deposit required is two months' rent. That’s quite a large sum upfront. Would you consider lowering it to one month?
Landlord
I understand your concern, but we require it to cover any potential damages or rent abatement if a tenant leaves unexpectedly.
Tenant
That makes sense. However, in case I need to move out earlier, would there be a penalty, or do you allow subletting?
Landlord
If you break the lease early without notice, it would be considered a breach of contract, and you’d be responsible for the remaining rent unless we find a new tenant. But as a landlord, I have a duty of mitigation of damages, meaning I’d try to rent it out quickly to minimize costs for both of us.
Tenant
That’s fair. I also noticed the lease includes a rent escalation clause, which means the rent may increase during the lease period. Could we negotiate a fixed rate instead?
Landlord
Unfortunately, that clause is standard due to market fluctuations, but we could cap the increase at 3%.
Tenant
Alright. One last thing—if I move in mid-month, would the first month’s rent be prorated rent?
Landlord
Yes, you’d only pay for the days you actually live in the apartment.
Tenant
That sounds reasonable. Also, I’d like to put down a holding deposit to reserve the apartment while I finalize my decision.
Landlord
That’s fine, but please note that it’s non-refundable if you decide not to proceed with the lease.
